  Session Description:  Attorneys from both state and federal government agencies will present on current topics related to mining and reclamation. These topics include the laws governing the creation of trusts for long-term treatment of acid mine drainage and how the State of Pennsylvania drafts and enforces these trusts; the requirements of state reclamation plans, drafted by the states with primacy over coal mining and reclamation operations and reviewed by the federal Office of Surface Mining and Reclamation Enforcement (OSMRE), as required by the Surface Mining Control and Reclamation Act of 1977 (SMCRA); and the program amendments review process, by which states ensure compliance with federal statutes and regulations by submitting updates to their plans of mining and as required by SMCRA.

Session Description:  Attorneys from several eastern states will present on legal issues pertaining to current enforcement actions, citizens’ appeals, and other related litigation on resource projects occurring within their respective jurisdictions, such as issues relating to coal regulation and enforcement under state primacy authority exercised under the Surface Mining Control and Reclamation Act of 1977 (SMCRA).

  Session Description:  Assistant U.S. Attorney Ross will present on the rules of ethics and professional responsibility as they relate to contacts with represented and unrepresented parties, with emphasis on how these rules govern communications to and from attorneys employed by governmental entities. This presentation is designed to meet the specific Ethics requirements for CLE.
